EXG Safaris Travel Terms & Conditions
By submitting a payment to Exg Safari (LLC) (“Exg Safari”) or participating in an Exg Safari tour, safari, or event (“Trip”), you hereby agree to these Travel Terms and Conditions outlined herein, along with any additional documents provided by us (collectively referred to as “The Agreement”), as well as any supplementary terms and conditions established by applicable suppliers for your travel arrangements. The Agreement defines the terms of your engagement with us when booking a Trip, outlining both your entitlements and obligations as a traveler (“Member”) that impact your legal rights. Therefore, it is of utmost importance that you thoroughly read and understand the entire Agreement. The primary traveler assumes the responsibility of communicating The Agreement to each fellow traveler covered by their booking. In instances where a Travel Advisor makes the booking, the Advisor is tasked with providing all travelers a copy of The Agreement. Exg Safari is not accountable for any Member’s lack of awareness regarding the Terms and Conditions or any other stipulations within The Agreement due to the failure of the lead traveler or Travel Advisor to disseminate this information to all fellow travelers. Should you have any inquiries regarding The Agreement, we encourage you to contact us before finalizing any booking.
You retain the right to cancel your reservation without incurring any penalties within ten (10) days of booking if you do not concur with these Terms and Conditions.
Reservation and Payment
Our team is prepared to confirm your reservation. Full payment is expected as stipulated on your itinerary. It is imperative that all payments be remitted punctually and in accordance with the guidelines we provide. Should we not receive the due payment in full and on schedule, we reserve the prerogative to regard your booking as canceled by you, thereby necessitating adherence to the cancellation charges delineated below. We maintain the right to reject bookings without being obliged to furnish reasons, and in such cases, we shall solely refund any deposit received. Reservations are not transferable.
Inclusions in an Exg Safari Trip
Prices are computed per person based on double occupancy and comprise the following: all lodgings; transfers to and from airports and transportation on land as indicated in each Trip itinerary; basic internet availability in hotel rooms (actual service levels are not assured); entertainment and special dinners arranged by Exg Safari; excursions and sightseeing; regular luggage handling (please consult the Luggage Policy); services provided by Exg Safari Directors or Guides; meals as specified in the itinerary. Appropriate gratuities for luggage handling, dining room servers, and guides are encompassed. Rooms featuring two beds are commonly designated for double occupancy. Rooms occupied by a single individual generally incur a higher cost compared to the shared cost among two or more occupants.
Exclusions from Exg Safari Trip
Trip prices do not encompass airfare and associated taxes to the Trip’s point of departure or termination (please refer to the Airline Reservation Services section). The air carrier’s terms and conditions, including cancellation terms, are applicable to your airfare. Gratuities for Exg Safari Directors and Driver Guides are not included and are left to the discretion of all Safari tour participants. As a courtesy, Exg Safari offers to arrange hotel accommodations preceding or following your Trip, contingent upon availability and upon request. These hotel expenses will be appended to your Trip’s overall cost. Individual expenditures such as phone calls, room service, alcoholic beverages, laundry services, excess luggage charges imposed by airlines, and other optional supplementary costs are not incorporated. The provided list is illustrative and not exhaustive of every item not covered by the Trip cost.
Airline Reservation Services
Airline reservations can be facilitated through Exg Safari for travel originating in the United States and Canada. By availing Exg Safari’s air services, you acknowledge that in acquiring, selling, or otherwise organizing air travel, Exg Safari functions solely as your agent in relation to independent contractors, the air carriers. Exg Safari bears no responsibility for accidents, deaths, injuries, illnesses, property damages, delays, or any other forms of loss or expenditure arising directly or indirectly from acts of God or actions or omissions (including service failures) or defaults by any carrier. Your airline ticket procured via Exg Safari serves as a contract between yourself and the airline. Exg Safari bears no responsibility for and does not accept liability for seat assignments, name changes, schedule alterations, flight modifications, missed connections, cancellations, requests for ticket fee refunds, or any other losses or expenses you incur for any reason (including, without limitation, bankruptcy, insolvency, carrier reorganization, or similar creditor relief). Exg Safari must manage ticketing for Exg Safari’s designated fares, which are contingent on availability and remain unconfirmed until reserved. Special fares cannot be combined with other promotional offers. Acquisition of Exg Safari’s air services necessitates concurrent acquisition of an Exg Safari Trip. Electronic ticket numbers shall be dispatched with final documentation. If you opt to cancel or alter your flights either before or after departure, you shall be subject to all airline-imposed cancellation and change fees. It is incumbent upon you to verify all departures 24 hours in advance and remain apprised of carrier-induced changes.
Conduct of Trip Members
By engaging in an Exg Safari Trip, you agree to abide by all regulations and guidelines established by Exg Safari, its representatives, and your Exg Safari Directors & Guides. Exg Safari retains the right to terminate your Trip participation should your behavior prove abusive towards others, disrupt the Trip, or negatively impact the overall experience for fellow participants due to your physical condition. In such instances, Exg Safari will not grant a refund and disclaims any liability in cases requiring your premature departure from the trip. Exg Safari bears no responsibility for expenses incurred by you as a result of your removal from a Safari vacation. Upon booking, you acknowledge accountability for any damages or losses attributed to you. You are obliged to remunerate the full amount for such damages or losses (assessed reasonably if not definitively determined) directly to the accommodation owner, manager, or other pertinent supplier. You also agree to indemnify us for the entire sum of any claims, including legal costs, lodged against us.
Health and Safety of Trip Members
Your involvement in Trip activities assumes a certain level of risk. Engaging in activities such as climbing, hiking, extended walks, tours, various modes of transportation, and recreational vehicles entails a greater risk of injury or death than your routine activities. Through participation, you willingly accept these inherent risks. Exg Safari lacks the qualifications to assess your physical fitness, thus evaluating your suitability for a given tour or activity is incumbent upon you (or your doctor). Exg Safari assumes no responsibility for Damages stemming from your participation in any Trip activity. On or prior to departure, you may be requested to sign waivers. Failure to do so may preclude your participation in the Trip or specific Trip activities.
Changes to Itinerary and Flexibility
Exg Safari is committed to delivering all Trips as advertised. Travelers should remain adaptable, as circumstances may necessitate alterations or exceptions to the itinerary. Exg Safari reserves the right to amend or truncate the itinerary, substitute hotels, sightseeing, and/or modes of transportation as deemed necessary. Any cost savings attributed to such changes shall be reimbursed to guests, while expenses arising shall be covered by Exg Safari.
Cancellation Policy
You reserve the prerogative to cancel your reservation with Exg Safari at any time prior to Trip departure. However, cancellations impose significant expenses. Consequently, cancellation could result in a penalty fee escalating with proximity to departure. Fees vary depending on the Trip; please consult the specific Cancellation Fees section.
Cancellation by Exg Safari
We retain the right to cancel or reschedule any departure for justifiable cause. In case of cancellation, except in instances of extreme circumstances as delineated below, we shall propose alternative arrangements. We may, at our discretion, offer travel vouchers or refunds following our cancellation policy. Any additional costs incurred for airfare or alternative travel arrangements not arranged by us shall be your responsibility.
Luggage Policy
Due to space limitations during Exg Safari Trips, we request that you limit checked luggage to one average-sized suitcase per person. In addition to complying with Exg Safari’s restrictions, it is imperative that you research and adhere to all airline baggage regulations related to your flights to and from the Trip. Your adherence to airline luggage guidelines is your responsibility, and Exg Safari shall not be held accountable for any costs or travel disruptions stemming from your failure to adhere to airline policies. It is essential to recognize that for Safaris with included on-tour flights, luggage weight restrictions for these flights may be lower than those for international flights; detailed information shall be provided in the pre-Trip travel documents. While every effort is made to handle luggage with care, we disclaim responsibility for loss or damage to luggage and personal effects due to mishandling by hotels, airlines, or ground transportation. Procuring comprehensive insurance to cover these eventualities is highly recommended.
Travel Document Requirements
To satisfy the Transportation Security Administration, passengers must furnish their name, date of birth, and gender when making airline reservations. For international travel, US citizens must possess a passport valid for at least 6 months beyond the return flight date. Non-US citizens should consult their booking agent or relevant consulate for comprehensive information regarding required documentation. It is your sole obligation to secure and fund any essential visas, reciprocity fees, affidavits, vaccinations, and other prerequisites for entry into each destination. Failure to possess the proper visas, passports, or other mandated documents may result in denial of departure or entry without recourse for refund, and Exg Safari shall bear no liability.
In light of the COVID-19 pandemic, all guests are obligated to adhere to health and safety regulations. Certain destinations may have specific requirements, including proof of negative COVID-19 tests, vaccinations, and health insurance. These guidelines supplement Exg Safari’s regulations and might be more stringent. It is your responsibility to understand destination-specific requirements. Additionally, Exg Safari reserves the right to impose additional documentation requirements for participation in a tour, and such requisites shall be communicated in advance of the Trip. Failure to possess appropriate visas, passports, or other obligatory documents may prevent departure from or entry into a country, and Exg Safari shall not be liable.
Traveling with Minors as a Guardian
When allowing a minor to partake in an Exg Safari Trip, parents and/or guardians of the minor participant accept full responsibility for the minor’s supervision and well-being during the Trip. They must ensure the minor adheres to all safety rules, both written and verbal. Parents and/or guardians release and indemnify Exg Safari from any and all Damages (including emotional distress) suffered by the minor. If you are traveling as the guardian of a child, carrying a letter from both parents authorizing emergency treatment is strongly recommended. For international travel, many countries require specific entry conditions for minors traveling internationally without BOTH parents. (Such measures are designed to counter child abduction.) It’s crucial to understand that Exg Safari is not accountable for travel disruptions due to insufficient documentation for children traveling without both parents.
Travelers Needing Special Assistance
Dietary Requests: While we strive to accommodate dietary requests, limitations inherent in our partner establishments might preclude the fulfillment of all requests at every meal.
Mobility: Regrettably, Exg Safari cannot provide special assistance for mobility, including walking, wheelchairs, motorized scooters, dining, or personal requirements. If such assistance is needed, you must be accompanied by an able companion who can provide assistance. Certain itineraries might be unsuitable for wheelchairs or motorized scooters. Exg Safari may necessitate a doctor’s certificate to ascertain your fitness for the Trip. If Exg Safari is unable to accommodate your needs or deems your health and safety at risk, Exg Safari reserves the right to decline your participation.
Photography and Video on Tour
Exg Safari may utilize photographs and/or videos taken during the tour by fellow travelers, Exg Safari Directors, Guides, or professional photographers for promotional purposes in print, online, and other media. Should you prefer not to have your image used in marketing activities, please notify your Exg Safari Director or Guides at the Trip’s outset.
Extreme Circumstances
Exg Safari disclaims liability for any loss, damage, delay, or cancellation stemming wholly or partially from an Act of God or any other Force Majeure condition. Such conditions include, but are not limited to, fire, volcanic eruptions, environmental pollution, inclement weather, earthquakes, low or high water levels, floods, water or power shortages or failures, tropical storms, hurricanes, riots, civil disturbances, and similar occurrences beyond Exg Safari’s control. In cases of Force Majeure, Exg Safari may offer credit in lieu of a monetary refund, applicable to a future Exg Safari Trip.
Supplier Agreements
Exg Safari does not own, operate, or control transportation, recreational vehicles, hotels, restaurants, or other services linked to a Trip. All tour services are subject to the terms and conditions outlined by the service provider, as well as the laws of the countries where services are rendered. The passage contract (Conditions of Carriage), when provided by airlines, shall constitute the sole agreement between said airlines and the Trip Member.
Limits on Exg Safari’s Responsibilities
While striving to offer optimal service, Exg Safari and its agents, employees, officers, directors, and affiliates act solely as agents for the Member. As such, they assume no liability for accidents, deaths, injuries, illnesses, property damages, delays, or other losses stemming directly or indirectly from acts of God or actions or omissions by any restaurant, carrier, motel, hotel, or other service provider. These providers, responsible for services, programs, and accommodations connected to a Trip, are considered independent contractors. Through participation in a Trip, you acknowledge that Exg Safari assumes no liability for Damages or issues arising from or related to the Trip, except in cases of gross negligence or willful misconduct by Exg Safari.
Modifications to Travel Terms and Conditions
Exg Safari reserves the right to rectify errors or omissions in published materials and amend these Travel Terms and Conditions due to legislative or regulatory changes. Revised Terms and Conditions shall take effect once posted on the ExgSafari.com website. It is incumbent upon travelers to review the website prior to travel for any modifications.
Controlling Law and Jurisdiction
Any legal claims, actions, or proceedings against Exg Safari shall be pursued only in a state or federal court in the State of Connecticut, USA, unless Exg Safari chooses otherwise. All such claims, actions, and proceedings shall be governed by and subject to the laws of the State of Connecticut. Exg Safari shall not be liable for anything beyond compensatory damages, and punitive damages are waived. Claims against Exg Safari must be brought in an individual capacity, not as part of a class action. You acknowledge and agree that Exg Safari may alter these Terms and Conditions, with changes taking immediate effect. By using our services, you signify your acceptance of the prevailing Terms and Conditions.
