Section
1. General Terms
By submitting payment of any deposit or balance for an EXG Safaris trip, you (“Traveler,” “Client,” or “Participant”) acknowledge and agree to these Terms and Conditions.
EXG Safaris LLC (“Company,” “we,” “our,” or “EXG Safaris”) is a California limited liability company and operates in partnership with licensed ground operators in Africa.
These terms supersede all prior verbal or written communications.

2. Deposits and Confirmations
2.1 Deposit Requirement
A non-transferable deposit equal to twenty percent (20%) of the total trip cost is required to confirm any booking.
2.2 Balance Payment
The remaining balance shall be due no later than ninety (90) days prior to the scheduled departure date, unless otherwise agreed in writing by the Company.
2.3 Confirmation of Booking
No booking shall be deemed confirmed until the required deposit has been received and acknowledged by the Company.
2.4 Failure to Pay
Failure by the Client to remit payment in accordance with the above terms may result in automatic cancellation of the booking, and applicable cancellation charges shall apply.
2.5 Payment Methods
Payments may be made by credit card, ACH, or wire transfer.
All credit card transactions are subject to a 3% processing fee.

3. Cancellations by Traveler
3.1 Notice of Cancellation
All cancellations must be submitted in writing via email to info@exgsafaris.com and shall only be effective upon written confirmation by the Company.
3.2 Refund Structure
Refunds, if applicable, shall be calculated based on the total trip cost and issued to the original form of payment.
The following cancellation charges shall apply:
91 days or more prior to departure: Refund of all monies paid, less a non-refundable administrative fee of USD $350 per person
90 to 61 days prior to departure: Fifty percent (50%) of the total trip cost shall be refunded
60 to 46 days prior to departure: Thirty-five percent (35%) of the total trip cost shall be refunded
45 days or less prior to departure: No refund shall be issued
No refunds will be issued for unused portions of a safari or voluntary withdrawal during travel.
3.3 Administrative Fee
The administrative fee of USD $350 per person represents a genuine pre-estimate of costs incurred by the Company, including but not limited to planning, coordination, and processing expenses, and shall be non-refundable under all circumstances.
3.4 Transaction Costs
Any refund issued may be reduced by non-recoverable transaction-related costs, including but not limited to credit card processing fees, banking charges, currency conversion costs, and any applicable governmental fees.

4. Cancellations or Modifications by EXG Safaris
EXG Safaris reserves the right to modify itineraries, dates, accommodations, or vehicles for safety, logistical, or regulatory reasons.
If EXG Safaris cancels a safari due to force majeure (e.g., natural disasters, political unrest, epidemics), all payments will be credited toward a rescheduled safari within 24 months or offer a trip to another destination.
EXG Safaris is not responsible for additional expenses (e.g., airfare, visas, vaccinations) incurred by travelers.

5. Changes, Modifications, and Rescheduling
5.1 Client-Initiated Changes
Any request by the Client to modify a confirmed booking must be submitted in writing and shall be subject to availability and approval by the Company.
The Company reserves the right to: Apply additional charges for any modifications; Treat substantial changes as a cancellation and rebooking.
5.2 Flexible Rescheduling Policy
In the event of unforeseen circumstances, including but not limited to geopolitical instability, armed conflict, airspace closures, governmental travel restrictions, or significant transportation disruptions, the Company may, at its sole discretion, permit the Client to reschedule the booked travel under the following conditions:
The rescheduled travel must occur within the same calendar month in the subsequent travel season
No rescheduling fee shall be charged by the Company; however, any increase in third-party supplier costs shall be borne by the Client
The Client must provide written notice of the requested rescheduling, including updated travel details, no later than ninety (90) days prior to the newly proposed departure date
5.3 Limitations
This rescheduling provision: Is offered as a goodwill accommodation and does not constitute a contractual right; Is strictly subject to availability and operational feasibility; Shall not apply to bookings that have already been canceled or completed.
5.4 Effect of Rescheduling
Once a Client accepts and confirms a rescheduled travel date, the original booking shall be deemed fully amended and replaced by the new booking. The rescheduled booking is final and non-refundable. The Client shall not be entitled to cancel the rescheduled booking and request any refund or travel credit, except where required by applicable law. Any rescheduling granted by EXG Safaris LLC is a goodwill accommodation and does not create any additional cancellation or refund rights.

6. Refunds and Chargebacks
Refunds, if applicable, will be processed within 30 business days of written approval.
Chargebacks are strictly prohibited without prior written communication and resolution attempt.
Any unauthorized chargeback will incur a $250 administrative fee, and EXG Safaris reserves the right to pursue legal and collection remedies under California Civil Code §3300 et seq.

7. Travel Insurance
Travelers are strongly advised to carry comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, repatriation, and baggage.
Failure to obtain adequate coverage releases EXG Safaris from any related liability or financial responsibility.

8. Responsibility & Liability Limitation
EXG Safaris acts solely as a booking agent for independent suppliers (lodges, airlines, ground transport).
EXG Safaris is not liable for injury, illness, loss, damage, delay, or expense caused by suppliers, acts of nature, war, strikes, civil unrest, or government actions.
Traveler assumes all inherent risks associated with travel in remote destinations.
In no event shall EXG Safaris’ liability exceed the amount paid by the traveler for services rendered.
California Civil Code §1668 disclaimer: Nothing herein releases EXG Safaris from gross negligence or willful misconduct, but EXG Safaris disclaims all other implied warranties to the maximum extent permitted by law.

9. Force Majeure
EXG Safaris shall not be deemed in breach for any failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, pandemics, border closures, or governmental restrictions.

10. Media & Marketing Release
By participating in an EXG Safaris safari, you grant EXG Safaris permission to use photographs, videos, or testimonials for marketing purposes unless you provide written notice of objection prior to departure.

11. Severability
If any provision herein is deemed invalid, the remainder of the agreement shall continue in full force and effect.

12. Acknowledgment
By making a booking or paying any deposit, the traveler affirms that they:
Have read, understood, and agreed to this policy;
Are physically fit and medically cleared for travel;
Accept full responsibility for their decisions, insurance, and participation.
